The SmartCare Website is the website dedicated to providing information about SmartCare products. By browsing the Website, you agree to these Terms and Conditions and consent to be bound by their provisions.
1. CONCEPTS AND DEFINITIONS
1.1. The Website: The SmartCare Website is available at smartcare.lt;
1.2. The Company: AVAD Baltic UAB (company code 301060619, address Raudondvario Pl. 131B, Kaunas);
1.3. SmartCare Warranty: The warranty service provided by the Company in accordance with the Terms and Conditions of the SmartCare Warranty;
1.4. SmartCare Insurance: A supplementary insurance product offered by the Company and its partners for Apple products;
1.5. SmartCare Products: SmartCare Insurance and SmartCare Warranty;
1.6. Terms and Conditions: The Terms and Conditions of the SmartCare Website, intended to inform Website visitors about the Website’s purpose, the information it contains, and the processing of personal data;
1.7. Customer: A person who wishes to purchase or has purchased a SmartCare Product;
1.8. Website Visitor: The person visiting the smartcare.lt website;
1.9. Customer Account: An account created for the Customer, where the Customer can check the information about the SmartCare Products they purchased.
2. THE SMARTCARE WEBSITE
2.1. The Website is a platform for providing information about SmartCare Products to Customers and Website Visitors who have purchased or intend to purchase said products. The website is available at smartcare.lt.
2.2. Information provided on the website:
2.2.1. SmartCare Warranty Terms and Conditions;
2.2.2. SmartCare Insurance Terms and Conditions;
2.2.3. Current prices and validity periods for SmartCare Products;
2.2.4. Information on the benefits and coverage areas of SmartCare Products;
2.2.5. Information on what to do in the event of an insurance or warranty claim;
2.2.6. Contact information of SmartCare after-sales service providers;
2.2.7. Contact information of partners offering SmartCare Insurance and the Extended Warranty;
2.2.8. Access to the Customer’s account for SmartCare Products they purchased, where they can:
View and download documents for purchased SmartCare Products, including the SmartCare insurance certificate, warranty certificate, Insurance Product Information Document (IPID), and current product terms;
Update the certificate’s expiration date to match the device purchase date;
Submit additional information about the purchased equipment, such as photos and purchase documents.
2.2.9. Contact information for further inquiries or to file a complaint about purchased SmartCare Products.
2.2.10. IMPORTANT The latest and most current information on SmartCare Products is always available at SmartCare distribution points. In case of discrepancies between the information published on the Website and that provided at SmartCare distribution points, the latter shall be deemed valid and up-to-date.
3. CREATING AND USING A SMARTCARE ACCOUNT
3.1. On the Website, visitors can find all relevant information about SmartCare Products, purchase them, and create a SmartCare account. A SmartCare account is created after purchasing at least one SmartCare Product.
3.2. To purchase a SmartCare Product and create a SmartCare account, the Website Visitor must complete a sign-in form, providing their email address. This address will be used by the Company’s representatives to communicate information about the visitor’s SmartCare Product purchase.
3.3. By using this Website, the user accepts and agrees to be bound by the Terms and Conditions.
3.4. By creating and using an account, the Website Visitor certifies that the personal data provided to the Company is true and accurate. If the data is provided by the visitor’s representative, the visitor confirms that it has been obtained and transmitted in accordance with all applicable personal data protection laws. Upon the Company’s request, the Website Visitor undertakes to provide documents substantiating the lawfulness of the collection and transfer of personal data.
3.5. The SmartCare account provides information belonging only to the account holder, including but not limited to the device purchase document and photographs. The Customer shall ensure the authenticity and legality of the documents and information provided in the SmartCare account. Data discrepancies may lead to the suspension of the corresponding SmartCare Product.
3.6. A SmartCare account is created by purchasing any SmartCare Product.
3.7. To log in to an existing SmartCare account, the Customer must provide their email address and the identification number of the Apple product for which they purchased a SmartCare Product, or the certificate number of the SmartCare Product they own.
3.8. The Customer shall be responsible for all actions taken in connection with the use of the account created for the Customer and shall assume all liability for any improper or unauthorised use of their SmartCare account.
3.9. If the Customer loses their login credentials, the Customer must immediately notify the Company by email at help@smartcare.lt.
3.10. In the event of a change in the Customer’s details, the Website Visitor must inform the Company in writing without delay, but not later than within 2 (two) business days.
3.11. Once the SmartCare Product for which the account was created expires, the certificate will become inactive. The Customer’s account will remain active for one (1) year after the certificate expires, allowing the Customer to view the expired certificate by its number for an additional year.
4. PROCESSING OF PERSONAL DATA
4.1. The controller of personal data for Website Visitors and Customers, responsible for determining the purposes and means of processing, is AVAD Baltic UAB, company code 301060619, address Raudondvario Pl. 131B, Kaunas.
4.2. The Company shall undertake to ensure the privacy of Website Visitors and clients, protect the confidentiality of their personal data, and disclose such data to third parties only in cases permitted by the laws of the Republic of Lithuania and/or the Privacy Policy.
4.3. The data of Website Visitors and Customers is processed as outlined in these Terms and Conditions, as well as the Website’s and the Company’s Privacy Policy. The personal data of Customers who have purchased SmartCare Products will be processed as specified in the rules for the respective SmartCare Product, to the extent applicable to that specific product.
4.4. The personal data of the Website Visitor and the Customer – the IP address and selected cookies – are processed based on the Company’s legitimate interest in ensuring the proper functioning and administration of the Website.
4.5. The Customer’s personal data – email address, purchased certificate number, and serial number of the device for which the certificate was purchased – are processed based on the contract with the Customer for the purpose of creating and administering the SmartCare account.
4.6. The personal data referred to in section 4.4 of the Terms and Conditions will be processed for a period of 1 year from the last visit to the Website.
4.7. The personal data referred to in Section 4.5 of the Terms and Conditions shall be processed for a period of two (2) years from the date of cancellation of the SmartCare account.
4.8. Certificates for SmartCare Products purchased by Customers and the data contained therein will be retained for two (2) years from the expiration date of the certificate, unless applicable legislation requires a longer retention period for these documents.
4.9. The rights of the Website Visitor and Customer as data subjects:
4.9.1. You have the right to access your processed personal data and to request corrections to that data;
4.9.2. You have the right to request the deletion of your personal data and to restrict its processing;
4.9.3. You have the right to data portability in cases provided by law.
4.10. The Website Visitor and the Customer may exercise their rights by contacting the Data Controller at the address specified in Section 1 of the Terms and Conditions, or by submitting a written request or a request signed with an e-signature to the email address help@smartcare.lt.
4.11. If you believe your rights have been violated, you may file a complaint with a supervisory authority (in Lithuania, this is the State Data Protection Inspectorate).
4.12. More information about the Company’s processing of personal data can be found in the Company’s Privacy Policy (AVAD Baltic Privacy), the Website’s Privacy Policy, and the terms and conditions of the respective SmartCare Product.
5. INTELLECTUAL PROPERTY
5.1. All information contained on this Website, including but not limited to its design, graphics, text, and software, is the property of AVAD Baltic UAB.
5.2. The Website Visitors and Customers may not distribute, copy, or otherwise use the information contained on the site without the Company’s written consent.
6. FINAL PROVISIONS
6.1. The Company shall be responsible for the cyber security of the websites, communications, and information systems or digital services under its control, and for the restoration of digital services in the event of a cybersecurity incident. Although the Company ensures compliance of the digital services with cybersecurity requirements and implements state-of-the-art cybersecurity measures proportionate to the risks identified, the Website Visitor and the Customer must understand that the security of using the digital services on the internet depends on their proper use of the capabilities provided by the digital services. Therefore, the Company shall not be liable for any direct or indirect damages arising from website inactivity, errors, inaccuracies in information provided by the Website visitor or the Customer, security vulnerabilities, or misuse of the Website. The Terms and Conditions are published and can be consulted at any time on the smartcare.lt website.
6.2. The Company reserves the right to unilaterally amend the Terms and Conditions at any time by publishing the updated version on the smartcare.lt website.
6.3. All disputes arising from these Terms and Conditions or related to the performance of the SmartCare guarantee shall be resolved through negotiation. If an agreement cannot be reached, disputes shall be settled in the courts of the Republic of Lithuania, in accordance with its applicable laws.
